Aspen's Short-Term Rental Program: Streamlining Regulations for 2025 | Avant Garde Aspen Luxury Real Estate

In June 2025, the Aspen City Council approved several updates to the city's short-term rental (STR) program, aiming to simplify administrative processes and enhance operational efficiency. These changes mark the first significant revisions since the original regulations were established in 2022.

Key Administrative Updates

The recent amendments focus on reducing the administrative burden for property owners and city staff:

  • Exemptions for Under-Construction Properties: Properties under construction are now exempt from certain tax-filing requirements, acknowledging that they are not yet operational.

  • Elimination of HOA Affidavit Requirement: The annual requirement for homeowners association (HOA) affidavits during permit renewals has been removed, streamlining the renewal process for existing permits.

  • Introduction of "Run-Out" Period and Temporary Permits: A new "run-out" period has been implemented, allowing existing bookings to be honored even after a property's sale. Additionally, a temporary permit type has been introduced to accommodate these scenarios, ensuring continuity for guests and hosts.

Permit Caps Remain Unchanged

While administrative processes have been streamlined, the Aspen City Council has decided to maintain the existing caps on short-term rental permits. These caps, established in 2022, limit the number of STR-Classic (STR-C) permits in certain residential and multifamily zones to 75% of the number of STRs that existed at that time. For example, the residential/multifamily zone district currently allows up to 190 STR-C permits, the highest cap among all districts.

By simplifying administrative procedures and maintaining permit caps, the city aims to create a more efficient and predictable environment for both property owners and residents.
